Lawyer, police commissioner differ over Occupy Providence protesters’ free-speech claim
PROVIDENCE, R.I. — Providence lawyer Miriam Weizenbaum said she has notified the city she will represent the Occupy Providence protesters if the city seeks a court order to remove them from Burnside Park, where they’ve been staying since Oct. 15.
City officials have said they would seek to enforce a city ordinance stating that the public park closes at 9 p.m. and that a permit is required for planned activities that would draw 25 people or more.
Likening the city’s argument to banning protesters from holding signs between certain times of the day, Weizenbaum, who is representing the group pro bono, says the protesters’ actions amount to protected free speech under the First Amendment.
Calls to city officials were not immediately returned Tuesday morning.
